If you are the plaintiff

This is your case. If you act as your own attorney, you are responsible for presenting the claim at each stage until it is finished.

  1. Use the defendant’s correct legal name. Complete one Form CP-001 for each defendant you sue.
  2. State the sum you claim and the reasons for it. You may also claim court costs of $350, legally applicable interest, and attorney’s fees if you state the amount.
  3. File the completed form with the Court through the TyGuys Roleplay Community Discord, and pay the $350 filing fee.
  4. The Court stamps a copy to show the filing and writes the cause number on the front of the form.
  5. The Court causes service on the defendant you named. In some cases the Court asks a law enforcement agency to locate the person, and that service may add a fee of up to $350.
  6. If the defendant asks for a trial, you will be told the place, the medium, the date, and the time. Be present, or the case will be dismissed.
  7. If the defendant does not file an answer, you may take a default judgment after ten days from the date the defendant received the suit.
  8. If you are awarded a judgment, you seek enforcement yourself. A Community Administrator may deduct funds from the defendant’s in-game account only when you present a signed order from this Court.

If you are not represented by an attorney, court notices and orders may be sent to you through the TyGuys Roleplay Community Discord, under the San Andreas Rules of Civil Procedure. Tell the Court promptly if your contact information changes.

If you were served

You are being sued in the Common Pleas Court by the plaintiff named on the summons. The judge has not made a decision. You have the right to a bench trial so you can tell your side.

  1. Fill out the answer form.
  2. Within three days after you receive the papers, deliver the answer to a judicial officer or an employee of the San Andreas Department of Justice through the TyGuys Community Discord.
  3. If you or your lawyer do not deliver that answer in time, judgment can be taken against you for the money demanded in the complaint.
  4. Once judgment is entered, your in-game bank account can be garnished or levied to satisfy it.

How papers are served

The Court commands any sheriff, sheriff’s deputy, or duly authorized law enforcement officer to serve the summons and a copy of the Statement of Claim, and to make a return to a judicial officer. Service may be made in either of these ways:

  • By researching records to find the person’s Discord identity, and sending a copy of the documents by direct message.
  • By reading the complaint to the person and telling them to contact the Court immediately.

The agency that serves the papers may claim the cost of service, up to $350, on the return.
